Terms of Service

These Terms of Service ("Terms") govern your use of the Flight Owl mobile application ("the app") operated by TBM Solutions LLC, a Wyoming limited liability company ("we", "our"). By creating an account or using the app, you agree to these Terms.

1. The Service

Flight Owl provides flight tracking, delay predictions, gate alerts, and related travel information for flights primarily within Europe. The service includes free and premium subscription tiers.

2. Accounts

• You must be at least 16 years old to create an account
• You are responsible for maintaining the security of your account credentials
• You may sign in with email/password, Apple, or Google
• One account per person. Automated account creation is prohibited
• You can delete your account at any time from Profile > Account > Delete Account

3. Flight Data

Flight data and delay predictions are provided for informational purposes only. While we strive for accuracy, we cannot guarantee the completeness or correctness of any flight information.

• Delay predictions are statistical estimates, not guarantees
• Gate and terminal information may change without notice
• Always verify critical travel information with your airline

On Android, Flight Owl includes Google Maps features and content. Use of those features is subject to the Google Maps End User Additional Terms of Service and the Google Privacy Policy.

4. Subscriptions

• Premium features require a paid subscription
• Subscriptions are billed by the app store you installed Flight Owl from, not by us. On iPhone that is Apple's App Store; on Android it is Google Play
• Prices are displayed in the app before purchase
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
• You can manage or cancel a subscription in your device's store settings. On iPhone: Settings, then your name, then Subscriptions. On Android: Google Play, then your profile, Payments & subscriptions, then Subscriptions
• Refunds are handled by the app store that billed you, not by us. For purchases made through Apple, see their refund policy
• Deleting your account does not automatically cancel an active subscription. Cancel it first via Settings > Subscriptions

5. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose
• Attempt to access data belonging to other users
• Reverse-engineer, decompile, or tamper with the app
• Scrape, automate, or make bulk requests to our API
• Circumvent rate limits, subscription checks, or security measures
• Impersonate other users or misrepresent your identity

6. Intellectual Property

The Flight Owl app, its design, code, and branding are owned by TBM Solutions LLC. Flight data is sourced from third-party providers and is subject to their respective terms. You retain ownership of any content you create (journal entries, notes).

7. Availability

We aim to keep the service available but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications at any time. We may discontinue the service with reasonable notice.

8. Limitation of Liability

To the maximum extent permitted by law:

• The app is provided "as is" without warranties of any kind
• We are not liable for missed flights, incorrect predictions, or travel disruptions
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim

9. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your data is deleted in accordance with our Privacy Policy.

10. Changes

We may update these Terms. Continued use after changes constitutes acceptance. Significant changes will be communicated through the app.

11. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law provisions.

Nothing in these Terms removes the protection of the mandatory consumer law of the country where you live. If you are a consumer in the European Union or the European Economic Area, you keep every right your local law gives you, and you may bring a claim in the courts of your own country.
